Scotland's Markets

Terms and Conditions

Last updated: October 2026

1. Introduction

Welcome to Scotland's Markets. These terms and conditions outline the rules and regulations for the use of our platform. By accessing this website and using our services, you accept these terms and conditions in full.

2. Definitions

  • "Platform" refers to the Scotland's Markets website and services.
  • "Trader" refers to individuals or businesses who book pitches at markets.
  • "Organiser" refers to individuals or organisations who manage and operate markets.
  • "User" refers to any person accessing or using the Platform.
  • "Pitch" refers to a designated trading space at a market.

3. User Accounts

To access certain features of the Platform, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account.

4. Trader Responsibilities

  • Traders must hold valid Public Liability Insurance with a minimum cover of £5 million.
  • Traders selling food must hold appropriate food hygiene certificates and registrations.
  • Traders must comply with all applicable laws, regulations, and market rules.
  • Traders are responsible for their own equipment, stock, and staff.
  • Traders must arrive on time and vacate pitches by the agreed time.
  • Traders must maintain their pitch area in a clean and safe condition.

5. Organiser Responsibilities

  • Organisers must provide accurate market information including dates, times, and locations.
  • Organisers are responsible for ensuring markets comply with local regulations.
  • Organisers must respond to booking requests in a timely manner.
  • Organisers must communicate any changes to market arrangements promptly.

6. Bookings and Payments

  • All bookings are subject to approval by the market organiser.
  • Payment terms are set by individual market organisers.
  • Cancellation policies vary by market and will be communicated at the time of booking.
  • The Platform facilitates bookings but is not responsible for disputes between traders and organisers.

7. Membership and Fees

  • Creating an account, browsing markets, searching, and managing bookings you already hold are free of charge for traders and organisers alike.
  • Memberships are not currently on sale. While they are switched off, every trading and organising feature is free, no trial has been started for any account, and no charge of any kind applies.
  • When memberships go on sale, the plans will be: Trader membership at £2.99 per month or £29.99 per year, and Organiser membership at £19.99 per month. These amounts are the total payable — we are not registered for VAT and no VAT is added.
  • Every new member starts with a 30-day free trial. The trial is granted inside the app, does not ask for card or payment details, and therefore takes no payment at all. It does not renew on its own.
  • A paid membership begins only when you choose a plan and pay for it yourself. Nothing is ever charged automatically at the end of a free trial.
  • You can cancel at any time from the Membership page in your account. Your membership then stays active until the end of the period you have paid for, and no further payment is taken after that.
  • Once a membership or trial has ended, your account and everything in it stays available to you — your existing applications, bookings, pitches, payments, receipts and messages can all still be managed and settled. Only starting new stall applications pauses until you choose a membership again.
  • The Platform does not charge a commission on stall bookings. Pitch prices are set by the market organiser, and traders pay the organiser directly under the organiser's own payment terms. The Platform is not a party to those payments or to any agreement between the trader and the organiser.
  • Any subscription fees charged before these terms were last updated remain governed by the terms in force at the time they were charged.

Full detail of the plans, the free trial, how to cancel and what happens to your access afterwards is set out in our Subscription and Cancellation Policy.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Scotland's Markets or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express permission.

9. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Nothing in these terms excludes or limits our liability where it would be unlawful to do so.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Platform will cease immediately.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Scottish courts.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified terms.
